Rules Violations

Clinical laboratory personnel are essential to patient care. Physicians and patients must trust that all reports and test results provided by clinical laboratory personnel are obtained by competent, licensed individuals free from bias.

The Board of Clinical Laboratory Personnel has strict rules regarding clinical laboratory personnel. Violating these rules can result in fines, suspension, or even criminal and civil legal penalties. The primary purpose of this course is to make sure you are aware of the types of violations that may be considered for disciplinary action. Please pay careful attention to the following several pages covering these violations. You are also strongly encouraged to read Chapter 64B3-12 in the Florida Administrative Code carefully, Rules of the Florida Clinical Laboratory Personnel Board, which explicitly addresses Discipline.
All complaints are investigated by the Department of Health and referred to a subcommittee of the Board called the Probable Cause Panel. This panel consists of two Board members who review the investigation reports and decide if a violation has likely occurred. The case is then referred to the Board for determination of guilt and punishment.
Ignorance of the laws and rules is not an acceptable defense should you be accused of wrongdoing.
